Civil Society Organizations call on Mexico to accept all recommendations issued during the UPR, except those contrary to national and international standards.
- CSOs urge the State to reject those recommendations which refer to hindering women`s access to sexual and reproductive health care and preventing same sex marriage.
Mexico City, 10 February 2014. Civil society organizations sent a letter to the Mexican Government urging it to accept all recommendations received during the past Universal Periodic Review (UPR), except those that are contrary to human rights standards. In doing so, Mexico would confirm its strong commitment to the respect for human rights and to the strengthening of universal mechanisms for their protection.
On 20 March, as part of Mexico's second UPR, the Mexican government will present its official position with regard to the acceptance of the recommendations received and the final report will be adopted at the Human Rights Council.
During the evaluation, which took place on 23 October, 2013, Mexico received 176 recommendations related to several issues relevant to the human rights agenda in Mexico. However, among those recommendations issued during the evaluation, two are contrary to applicable human rights standards, and therefore, Mexico should reject them.
Recommendation number 48 urges Mexico to “respect and defend life from conception to natural death, based on amendments of state constitutions, promoting a similar protection at federal and local levels”.
In this regard, human rights organizations noted that the amendments to which the recommendations refer, were intended to protect life from the moment of conception, generating a climate of penal persecution of women. Moreover, the recommendation is contrary to the jurisprudence set by the Inter-American Court of Human Rights, which explicitly states that it is not admissible to grant the status of person to the embryo. Similarly, the Committee for the Elimination of Discrimination Against Women (CEDAW) expressed their concern on the effects that the 16 local amendments are having and recommended that Mexico guarantee access to reproductive health services for all women without discrimination.
Furthermore, recommendation 114 urges the State to “preserve and protect the natural family institution and marriage as the conjugal union between a man and a woman based on their free consent”.
Precisely on this matter, the Mexican Supreme Court of Justice ruled in August 2010 that the amendment in Mexico City defining marriage as the “free union of two people” protected the rights to equality, non discrimination, freedom and the free development of personality, and therefore establishes same sex marriage as constitutional.
Both recommendations, far from contributing to the recognition and protection of human rights, hinder their compliance, favor discrimination and promote the criminalization of women at the expense of human rights.
Therefore, the undersigned civil society organizations make a strong appeal to the Mexican Government to reject both recommendations.
